MichalKids Terms of Service

1. General Provisions
1.1. These Terms of Service govern the use of the MichalKids application ("Application", "Service"), available on Android mobile devices and via the web interface.
1.2. Service Provider: DevOps Jakub Pazdyga, ul. Powstancow Slaskich 57a, 44-361 Syrynia, Poland, Tax ID (NIP): 2220682818, REGON: 241415540.
1.3. By using the Application, the user accepts these Terms of Service in full.
1.4. The Application is intended for families and serves to ensure children's safety by their parents or legal guardians.
2. Definitions
- User — a natural person using the Application
- Parent/Guardian — an adult with parental rights or guardianship over a child
- Child — a minor whose device is under the care of a Parent/Guardian
- Family — a group of Users linked within a single family account
- Device — a phone or tablet with the Application installed
- Safety Zone (Geofence) — a defined geographical area covered by the Application
- Subscription — a paid Premium plan providing access to extended Application features
3. Terms of Use
3.1. To use the Application, the following is required:
- A mobile device running Android 8.0 or later
- An active internet connection (WiFi or mobile data)
- Enabled GPS location services
- Consent to the required application permissions
3.2. Parent account registration requires a valid email address and password creation.
3.3. Adding a child's device requires:
- Consent to the processing of the child's personal data
- Consent to the collection of the child's location data
- Providing the child's name and selecting an age group
- Pairing the device via QR code or PIN
4. Application Features
4.1. The Application provides the following features:
- Location — displaying the child's position on the map in real time
- Safety zones — defining areas and receiving notifications when the child enters or leaves them
- Activity — screen time information and device activity
- Device status — battery level, connection status, WiFi mode
- Route history — browsing location history
- Notifications — alerts about important events (low battery, zone exit)
4.2. Location accuracy depends on GPS signal availability, internet connectivity, and environmental conditions. The Application does not guarantee 100% location accuracy.
5. Payments and Subscription
5.1. The Application offers three plans: Free (with basic features), Standard (paid, with extended access to features), and Premium (paid, with full access to all features).
5.2. Paid plan prices:
- Standard — monthly subscription: PLN 14.99/month; annual: PLN 129.99/year
- Premium — monthly subscription: PLN 29.99/month; annual: PLN 249.99/year
5.3. Payments are processed via:
- PayU S.A. — credit/debit cards (Visa, Mastercard), bank transfers, BLIK
- Revolut — card payments, Revolut Pay
- Google Play — in-app purchases via Google Play Store
5.4. New users may take advantage of a 30-day free trial of the Premium plan. After the trial period ends, the account automatically reverts to the Free plan unless the user purchases a subscription.
5.5. The subscription renews automatically at the end of each billing period (monthly or annually). To avoid the next payment, the subscription must be canceled before the end of the current period.
5.6. Subscription cancellation is available at any time in the Application Settings. After cancellation, Premium features remain active until the end of the paid billing period.
5.7. All prices are listed in Polish zloty (PLN) and include VAT.
5.8. PayU S.A. is the payment processor. DevOps Jakub Pazdyga does not store users' credit card or bank account data — it is processed directly by PayU S.A. (PCI DSS Level 1 certified).
5.9. In the event of a failed payment upon subscription renewal, the system will attempt up to 3 payment retries over a 3-day period. The user will be notified by email of each attempt. If payment is not successfully collected after 3 attempts, the subscription will be automatically downgraded to the Free plan, and any granted promotions (including referral discounts and beta-testing bonuses) will be permanently and irrevocably revoked.
6. Order Fulfillment
6.1. Premium subscription activation occurs immediately after the payment is confirmed by the payment processor (PayU or Google Play).
6.2. After completing the payment, the user is redirected to a confirmation page within the Application showing the transaction status.
6.3. Access to Premium features is activated within seconds of payment confirmation by the processor.
6.4. In the event of a payment failure, the user is notified on the confirmation page and may retry the payment.
7. Right of Withdrawal
7.1. In accordance with Article 27 of the Polish Consumer Rights Act of 30 May 2014, a User who is a consumer has the right to withdraw from the contract within 14 days of its conclusion without stating a reason.
7.2. Pursuant to Article 38(13) of the Consumer Rights Act, the right of withdrawal does not apply to contracts for the supply of digital content not recorded on a tangible medium, if the performance has begun with the consumer's express and prior consent and after the consumer has been informed of the loss of the right of withdrawal.
7.3. Before making a payment, the user is asked to consent to the immediate commencement of the digital service, which constitutes a waiver of the right of withdrawal pursuant to Article 38(13).
7.4. If the user has not waived the right of withdrawal, the withdrawal statement should be sent to:

7.5. Refund of payment is made within 14 days of receiving the withdrawal statement, using the same payment method used by the consumer.
8. Complaints
8.1. Complaints regarding the Application's operation or payments may be submitted via:

8.2. A complaint should include: a description of the problem, the user's contact details, and the desired resolution.
8.3. A response to the complaint will be provided within 14 calendar days of its receipt.
8.4. A consumer User may use the online dispute resolution (ODR) platform available at: https://ec.europa.eu/consumers/odr/.
9. School Mode and Bedtime Mode
9.1. The parent/guardian is responsible for configuring the child's device lock schedules.
9.2. While the device is locked, access to features is restricted — only the SOS function is available.
9.3. The parent may unlock the device at any time using the PIN code.
9.4. MichalKids is not liable for consequences arising from incorrect schedule configuration.
10. Distribution and Updates
10.1. The User acknowledges that the Application may be downloaded directly from michal.kids (outside the official Google Play Store).
10.2. MichalKids guarantees that the APK file available on the website is identical to the Google Play version and signed with the same digital key.
10.3. The User is responsible for regularly updating the Application to the latest version.
11. Beta Program
11.1. MichalKids offers a closed beta testing program. Participants receive:
- 3 months of Premium subscription free of charge after the beta phase ends
- 10% discount on the annual subscription
- 1 month of Premium free for each referred user who creates an account
11.2. Beta program terms may change. Participants will be notified of any changes by email.
12. User Obligations
12.1. The User agrees to:
- Use the Application in accordance with its intended purpose
- Provide accurate information during registration
- Protect login credentials from third-party access
- Obtain the child's consent (as appropriate to their age and maturity) for the use of location services
- Not use the Application for illegal purposes
- Not interfere with the operation of the Application or server infrastructure
12.2. The Parent/Guardian bears full responsibility for how data obtained through the Application is used.
13. Personal Data Protection
13.1. Detailed information about personal data processing can be found in the Privacy Policy.
13.2. By using the Application, the User consents to the processing of personal data in accordance with the GDPR and applicable legislation.
13.3. Children's location data is specially protected and accessible only to authorized family members.
14. Limitation of Liability
14.1. The Application is a tool to support childcare and does not replace direct parental supervision.
14.2. We are not liable for:
- Location inaccuracies caused by technical conditions
- Service interruptions due to maintenance or outages
- Actions of third parties compromising the User's account security
- Damages resulting from improper use of the Application
- Data loss caused by force majeure events
14.3. Maximum liability is limited to the amount of fees paid by the User for the Premium subscription.
15. Intellectual Property
15.1. The Application, its source code, graphics, logo, and other elements are protected by copyright law.
15.2. The User receives a free, limited license to use the Application in accordance with its intended purpose.
15.3. Copying, modifying, decompiling, or distributing the Application without written consent is prohibited.
16. Contract Termination
16.1. The User may delete their account at any time, which results in:
- Deletion of all User data from the servers
- Disconnection of all paired devices
- Loss of access to location history and statistics
- Cancellation of the active Premium subscription (no refund for the unused period)
16.2. We reserve the right to suspend or delete a User's account in the event of a violation of these Terms of Service.
17. Amendments to the Terms
17.1. We reserve the right to amend these Terms of Service.
17.2. Users will be notified of material changes with 14 days' advance notice via the Application or email.
17.3. Continued use of the Application after the changes take effect constitutes acceptance of the updated Terms of Service.
18. Final Provisions
18.1. These Terms of Service are governed by Polish law.
18.2. Any disputes shall be resolved by the court having jurisdiction over the registered office of DevOps Jakub Pazdyga.
18.3. If any provision of these Terms is found to be invalid, the remaining provisions shall remain in force.
